Speechkin Pilot Terms

1. Pilot and acceptance

These Terms govern the invite-only U.S. Speechkin pilot. By accepting after receiving links to these Terms and the Pilot Privacy Notice, you agree to these Terms and confirm that you are at least 18 years old and physically located in the United States. The pilot is open to residents of any U.S. state; you agree not to submit health, medical, or other sensitive information as described in these Terms and the Pilot Privacy Notice.

Participation is voluntary. You may stop at any time. Stopping does not automatically reverse processing already completed, but you may request deletion as described in the Pilot Privacy Notice.

2. What Speechkin provides

Speechkin interviews you about a wedding speech or vows and uses your approved material to help organize and draft the text. During the concierge pilot a member of the Speechkin team reads the answers you send and enters them into Speechkin.

Speechkin is a writing aid, not a legal, therapeutic, professional, or fact-checking service. It does not verify stories, identities, permissions, or factual claims. You must review and edit the draft before using or sharing it.

3. Your content

You keep any rights you have in the content you submit.

You grant Speechkin a limited, non-exclusive, worldwide license to host, transmit, reproduce, and transform your submitted content only as needed to provide and secure the pilot, create and deliver your story cards and draft, provide support, and evaluate the pilot using feedback and aggregated operational results as described in the Pilot Privacy Notice.

This license does not permit Speechkin to publish your stories, use them in marketing or testimonials, keep raw story text beyond the stated pilot period, or use story content to train a model. Any such use requires separate, specific permission.

You represent that:

You do not promise that you have obtained formal consent from every person mentioned in an ordinary anecdote. You remain responsible for deciding whether it is lawful and appropriate to submit, use, and publicly tell a story.

4. AI-assisted output

Speechkin uses an AI service to help with interviewing and drafting. The output can contain mistakes, omissions, awkward phrasing, or material that needs correction. It may not be unique and may resemble output produced for others.

As between you and Speechkin, and to the extent the law permits, Speechkin assigns to you any rights it may have in the output created for you. This does not guarantee that every part of the output is copyrightable, exclusive, non-infringing, or suitable for your use. Your inputs, selection, arrangement, and edits may affect copyright protection. You are responsible for reviewing the draft for truth, permissions, privacy, tone, and suitability before you use it.

5. Off-limits topics

Speechkin tries to honor the topics you mark off-limits, but automated filtering is not a guarantee. Give only short neutral labels, such as a first name or a one-word tag, and do not explain a private fact merely to exclude it. Review the complete draft before use and remove anything you do not want disclosed.

6. Privacy and human access

The Pilot Privacy Notice explains what data is processed, the team's human access, the AI-provider routing, browser storage, retention, deletion, and optional uses. It is incorporated by reference for disclosure, and acknowledging it is not a waiver of privacy rights.

7. Price and payment

The pilot price is shown before checkout. You pay only if you choose to purchase after viewing the preview, subject to the pilot offer communicated to you. Payments may be processed by Stripe under its own terms and privacy policy; Speechkin does not receive your complete payment-card number. The refund policy for the pilot is communicated with the offer. Nothing in these Terms limits non-waivable consumer rights.

8. Feedback, testimonials, and publicity

You may give feedback about the pilot, and Speechkin may use non-identifying operational feedback to evaluate it as described in the Privacy Notice. Speechkin may not use your name, likeness, testimonial, story, draft, or identifiable excerpt in marketing or public materials without separate written permission that identifies the approved material and its attribution.

9. Availability and pilot changes

The pilot is experimental and may change, pause, or end. Speechkin may refuse or stop participation where needed for safety, law, security, or abuse prevention.

10. Disclaimers

To the maximum extent the law permits, the pilot is provided as is and as available. Speechkin disclaims implied warranties to the extent they may legally be disclaimed and does not warrant that the draft will be error-free, unique, copyrightable, or suitable for a particular event or audience. This section does not limit rights or warranties that cannot legally be excluded.

11. Limitation of liability

To the maximum extent permitted by law: (a) Speechkin and Back and There LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of Speechkin, even if we have been advised of the possibility of such damages; and (b) the total aggregate liability of Speechkin and Back and There LLC for all claims arising out of or relating to Speechkin or these Terms will not exceed the greater of (i) one hundred U.S. dollars ($100) or (ii) the total amount you paid to Speechkin in the twelve (12) months before the event giving rise to the claim.

These limitations do not apply to liability that cannot be excluded or limited under applicable law, or to liability arising from our gross negligence or willful misconduct. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

12. Governing law and disputes

These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules, except where the non-waivable consumer-protection laws of your state of residence provide otherwise.

Before filing any claim, you and Speechkin agree to first try to resolve the dispute informally: email support@speechkin.com with a description of the issue, and both parties will make a good-faith effort to resolve it within sixty (60) days. If the dispute is not resolved within that period, it will be brought, to the extent permitted by applicable law, exclusively in the state or federal courts located in Maryland, and you and Speechkin each consent to the personal jurisdiction of those courts. Either party may instead bring an individual claim in a small claims court of competent jurisdiction, and this informal-resolution step does not delay or bar a small claims filing.

Speechkin does not require arbitration and does not ask you to waive participation in a class action. Nothing in these Terms limits any non-waivable rights you have under the law of your state of residence.

13. Changes

Material changes do not apply retroactively to previously submitted raw story content without notice and, where required, renewed agreement. The current version and effective date appear at the top.
